6. User-Generated Content

Users may have the opportunity to submit, post, or otherwise transmit content through the services ("User-Generated Content"). By submitting User-Generated Content, you grant pointpadane.mobi a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, publish, translate, distribute, and display such content in any media.

You represent and warrant that you own or have the necessary rights to the User-Generated Content you submit and that such content does not infringe upon the rights of any third party. pointpadane.mobi is not responsible for any User-Generated Content and does not endorse any opinions expressed therein.

pointpadane.mobi reserves the right to monitor, review, and remove any User-Generated Content at its sole discretion, without notice, for any reason, including but not limited to violations of these Terms of Service.

7. Payment Terms

Access to certain features of the services may require payment of fees. By subscribing to our services, you agree to pay all applicable fees as outlined on the pointpadane.mobi website. All fees are non-refundable unless otherwise stated in writing by pointpadane.mobi.

Payment shall be made in accordance with the payment terms specified at the time of purchase. You authorize pointpadane.mobi to charge your chosen payment method for the fees incurred. If your payment method fails or your account is past due, we may suspend or terminate your access to the services.

All fees are subject to applicable taxes, which will be added to your total invoice. You are responsible for paying all taxes associated with your use of the services.

pointpadane.mobi reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that pointpadane.mobi will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

9. Limitation of Liability

  • Any content obtained from the services; and
  • Unauthorized access, use, or alteration of your transmissions or content.

In no event shall pointpadane.mobi’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

10. Termination

These Terms of Service are effective until terminated by either you or pointpadane.mobi. You may terminate these Terms of Service at any time by discontinuing your use of the services and deleting your account. pointpadane.mobi may terminate these Terms of Service at any time, without notice, for any reason, including but not limited to your breach of these Terms of Service.

Upon termination, your right to use the services will immediately cease. All provisions of these Terms of Service which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination of your account does not relieve you of any obligations to pay any outstanding fees or charges incurred prior to termination.
